EU AI Act Enters Enforcement Phase: A New Era of Tech Regulation Begins

The European Union's Artificial Intelligence Act, widely regarded as the world's most comprehensive legal framework governing AI systems, entered its enforcement phase in early 2026 as key compliance deadlines passed for high-risk AI systems deployed in areas including critical infrastructure, employment, education, and law enforcement. The European AI Office, established within the European Commission, began its first formal compliance reviews of major technology platforms, signalling that the era of self-regulation for AI in Europe is definitively over.

Under the Act, AI systems classified as high-risk must meet strict requirements around transparency, data governance, human oversight, and accuracy before they can be placed on the European market. Systems deemed to pose unacceptable risks — including real-time biometric surveillance in public spaces and AI-based social scoring — are categorically prohibited. General-purpose AI models, including large language models used by major technology companies, must register with EU authorities and comply with transparency and cybersecurity obligations.

The first notable enforcement action targeted a major US-based recruitment platform that had deployed an AI-powered candidate screening tool across European operations without completing the required conformity assessment. The European AI Office issued a preliminary warning and ordered the platform to suspend the system's deployment pending a full review. Legal analysts described the action as a clear signal that the Commission intends to enforce the regulation rigorously rather than offering extended grace periods to big tech companies.

Industry reactions have been mixed. European AI startups have broadly welcomed the regulation as a framework that builds public trust and potentially gives compliant European companies a competitive advantage over less transparent rivals. Major US tech companies, however, have lobbied intensively against several provisions, arguing that compliance costs are disproportionate and that overly broad definitions of high-risk AI could stifle innovation. The debate over where exactly to draw the line between beneficial automation and unacceptable risk remains fierce.

For European businesses, the Act creates significant new compliance obligations but also opportunities. A new ecosystem of AI auditing firms, compliance consultancies, and technical standards bodies has emerged to help companies navigate the regulatory landscape, generating substantial economic activity in its own right.
