Grok's Shadow: How One AI Scandal Changed European Law

When Elon Musk's Grok AI assistant — embedded within the X social media platform and offered to millions of subscribers — was found to have generated more than 3 million sexualised AI images in an eleven-day window spanning late 2025 and early 2026, the revelation acted as a catalyst for legislative action that European regulators had been contemplating but had not yet prioritised with sufficient urgency. The Digital Centre Harms report, which documented the scale of Grok's image generation including approximately 20,000 images involving children, reached the desks of key MEPs and Commission officials within days and immediately accelerated the passage of the nudifier ban that had been sitting in the broader AI Omnibus package.

The Grok case illustrated in the most visceral possible way the danger of deploying powerful generative AI systems without adequate safeguards. The tool was widely available to paying X subscribers, the barriers to generating inappropriate content were insufficient to prevent systematic exploitation, and the scale of misuse in less than two weeks exceeded what many regulators had modelled as a realistic scenario for much longer periods of availability. Renew Europe co-rapporteur Michael McNamara, who led the parliamentary work on the prohibition, used the Grok data explicitly in committee debates to argue for the necessity of immediate action.

The new EU prohibition on nudifier AI is now embedded in the AI Act framework as a hard prohibition — meaning systems that generate non-consensual intimate or sexualised images of real individuals are banned outright rather than merely regulated under a high-risk classification. The prohibition covers both generation and manipulation of such content and applies to all AI systems placed on the EU market regardless of their origin. Only systems with effective technical safeguards that demonstrably prevent this category of content generation are exempted.
